There is a growing tendency worldwide among Islamic scholars to re-examine the existing laws applicable to Muslims and to bring them in conformity with the true Islamic 'precepts based on the original sources. The present book is a study of the judicial trend since 1950 till date. The purpose of the book is to measure from well established principles of Islamic Law. The post-Constitution decisions have followed the earlier decisions. The study, therefore, includes analysis of some of the earlier decisions as well. It is not intended to present the original ideas on the subject but an attempt has been made to collect and compile the basic material at one place to demonstrate how the Indian courts have interpreted them in their task of administration of justice. Under Shariah, Muslim jurists say that administration of justice is a part of the great responsibility which is entrusted by Allah to human beings. This book is divided into several chapters in light of all relevant Quranic verses and hadith with concluding remarks.
