    1. What are the “Pass benefits”?

    Benefits will include exclusive offers, challenges, collectibles etc. for Pass holders. Benefits will be notified from time to time.

    1. When can I start availing the Pass benefits?

    The pass benefits can be availed from the time of registration till the user’s ongoing academic course is completed.

    1. On which products are the pass benefits applicable?

    The eligible products will keep changing from time to time and will be visible to Pass holders with the associated offers.

    1. Who is eligible to buy a Student Pass?

    Any user who is successfully verified as a student enrolled for a degree bearing program with any online/offline institution will be eligible for a Student Pass.

    PRELIMINARY:

    • This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record does not require any physical or digital signatures
    • This Program is being run and powered by participating sellers (“Seller”) on www.flipkart.com, Flipkart Mobile App, Flipkart Lite Platform (collectively “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart”).

    • By participating in this Program, the user (“Customer”, “You”or“Your”) agrees to be bound by:

      • these terms and conditions (“T&C”); and
      • the Terms of Use, Privacy Policy, and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform.

    DEFINITIONS:

    • “Student pass” (individually “Pass” and collectively “Passes”) shall mean the facility that offers ‘Pass Benefits’ (defined below) to the customers on purchase of eligible products offered by the Seller on Platform
    • “Pass Benefits’’ shall mean the benefits that a Customer is entitled to avail on on successful registration and verification as a student.
    • “Products” shall mean the products sold by the Seller on the Platform under Flipkart.
    • “Validity Period” shall mean the duration during which the Pass Benefits shall be applicable.

    TERMS AND CONDITIONS:

    • To participate in the Program, You must do/ fulfill the following:

      • Must have a valid account on the Platform and log into the same;
      • Get yourself verified as a Student, if not already done (This offer is valid only for Student verified users);
      • Buy eligible Products on the Platform during the Validity Period.
    • Students Pass entitles the Customer to avail the Pass Benefits on the purchase of the eligible Products.
    • The Pass Benefits will automatically apply on purchase of eligible Products during the Validity Period. No codes need to be applied by Customer for availing Pass Benefits.
    • Only one Students Pass can be availed per user at a time. If a user has multiple Flipkart accounts, they will be able to avail Pass benefits only on one account.
    • Students Pass is non-transferable.
    • These terms and conditions are in addition to the Flipkart Terms of Use, and Your usage of the Platform shall be construed as Your acceptance of these terms and conditions and You shall remain bound by the same.
    • You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorized persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstandings and Flipkart shall not be responsible in any manner.

    GENERAL TERMS AND CONDITIONS:

    • Information You Provide Us: We may collect Personal Data (i.e., any data recognized under applicable data privacy laws and identifies you specifically) from you, such as your first and last name, phone-number, e-mail and mailing addresses, password, when you create an account to log in to our platform (“Account”). Your PAN details, Date of Birth and your photograph is also collected for KYC purposes. Additionally we collect the bank account details to facilitate the disbursement of revenue from any sale made on the platform. For students enrolling under the Student Club program, we may collect additional details such as your University and graduating year to facilitate the verification of your eligibility for the program We may also request additional information such as your social media identifier for the completion of certain challenges. It is possible there may be additional features made available on the Platform in the future which may require additional personal/sensitive information from you. Should this happen, we will update our Privacy Policy and notify you of the same. Currently our services are only available on the Mobile applications as such we may collect your phone number and the unique device id number. Our Service lets you store preferences like how your content is displayed, your location. Certain Services, such as two-factor authentication, may require our collection of your phone number. We may associate that phone number to your mobile device identification information. If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply. We also collect other types of Personal Data that you provide to us voluntarily and other requested information if you contact us via email regarding support for the Services. We may also collect Personal Data at other points in our Service that state that Personal Data is being collected. As you navigate through and interact with our Service, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns. To make our Service more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.
    • The Program is open to only end consumers and not to resellers.
    • Pass Benefits shall not be settled in lieu of cash by the Seller or Flipkart.
    • Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Program.
    • This Program is valid only for the Student verified users
    • Flipkart and Seller reserves the right to terminate, withdraw, suspend, amend, extend, modify, add or remove portions of this Program, at any time without any prior written notice and such amended terms and conditions will thereupon apply to and be binding on the Customer. By continuing to access or use the Platform or any features attached to it, the Customer will be deemed to have agreed to accept and be bound by such amended terms and conditions.
    • By participating in this Program, it would be deemed that You have given Us Your consent to contact You through call, SMS or email on the details provided by You for the purpose of this Program.
    • This Program is subject to the prevailing laws of India.
    • Flipkart does not endorse the products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products, which shall be at the sole liability and responsibility of the Seller.
    • You are not bound in any way to participate in this Program. Any participation is voluntary, and the Program is being made purely on a best effort basis.
    • Nothing herein amounts to a commitment by the Seller to conduct further, similar or other programs.
    • Any queries/complaints or disputes regarding the Program can be directed to the Flipkart customer care.
    • Any query regarding the Program will be entertained until 10 days following the last day of the Validity Period. Post such date, Seller and/or Flipkart will not entertain any correspondence or communication regarding this Program from any persons.
    • Flipkart and Seller reserves the right to disqualify the Customer account from the benefits of this Program, if any fraudulent activity is identified as being carried out for the purpose of availing the Pass Benefits under the said Program. Flipkart and Seller reserve the right to immediately suspend or terminate the use of any Pass that is used fraudulently or in contravention of the terms & conditions of the Platform or in contravention of these terms and conditions.
    • The Program shall be subject to force majeure events and on occurrence of such an event; the Program may be withdrawn at the discretion of Flipkart and Seller.
    • Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Program.
    • By participating in this Program, you agree to be bound by these terms and conditions of the Program, standard terms and conditions, terms of use, privacy policy (subject to change) of the Platform and the terms and conditions of the Seller.
    • You hereby agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Flipkart as a consequence of (i) violation of the terms of this T&C by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in wilful misconduct or negligence on Your part.
    • This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
    • The Program shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
