    TERMS & CONDITIONS OF OFFER A

    PRELIMINARY

    1. This is a promotional offer ('Offer') from Malindo Airways Sendirian Berhad ('the Carrier') being run on flipkart.com('Website'), Flipkart Mobile App, Flipkart Lite Platform (collectively 'Platform'), which Platform is owned and operated by Flipkart Internet Private Limited ('Flipkart')

    2. By participating in this Offer, user ('You', 'Your'or'Participant') agree to be bound by the following:

      1. the Offer terms and conditions below ('T&C');

      2. the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof,that are published on the Platform; and

      3. all applicable terms and conditions of Malindo Airways.

    OFFER DETAILS

    1. The Offer will commence at 00:00 hrs on May 14, 2017 and end at 23:59 hrs on May 18, 2017 ('Offer** Period**').

    2. To participate in the Offer You must to do/ fulfill the following:

    4. Must have a valid account on the Platform, log into the same and shop during the Offer Period.

    5. The top 20 spenders with the highest amount of purchase (net of cancellations and returns) made on the Platform during the Offer Period ('Winner/s') will stand a chance to win for himself/ herself a return economy class ticket from the Carrier's online points in India to Kuala Lumpur, Malaysia ('Prize/s').

You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Flipkart or the Carrier shall not be responsible in any manner.

    OTHER TERMS AND CONDITIONS

    1. Festival and high season surcharge will apply. All kind of taxes, fuel hikes as and when received, would be applicable with immediate effect. Prizes are available for travel in select months only at the sole discretion of the Carrier.
    2. The travel will be governed by the Carrier's contract of carriage and Flipkart will not be the party to the same.
    3. You must reach out to the Carrier's customer care executive at info_india@malindoair.com or 011 4351 5922/33 in case of any queries/ concerns in relation to fulfilment of Offer benefits.
    4. In case of any dispute or difference arising concerning the Offer or any alleged defect or deficiency of service availed, the same shall be resolved through arbitration as per the Arbitration and Conciliation Act 1996 conducted in Bangalore.
    5. All statutory taxes (direct or indirect, including local levies, TDS, registration fees, Insurance) on the Offer shall be payable by the Participant. Carrier or Flipkart will not be responsible / liable for the same.
    6. This Offer is subject to the prevailing laws of India.
    7. All decisions pertaining to the selection of Winner for this Offer are at the discretion of the Carrier and Flipkart.
    8. This Offer is funded from a special promotional budget created by the Carrier and is subject to change at any time at the sole discretion of the management of the Carrier.
    9. Prizes shall not be settled with cash in lieu by Flipkart or the Carrier and are not transferable.
    10. The Prizes under this Offer is guaranteed subject to the above and shall not be withdrawn by the Carrier voluntarily unless there is a force majeure situation rendering the Carrier unable to perform the services, for reasons beyond the Carrier's control, such as, but not limited to force majeure such as Acts of God, acts of civil or military authorities, acts of public enemy, terrorist attacks, war, threat of war, destruction of network, strikes, lock-out, riots, civil disturbances, political disturbances, insurrections, accidents, explosions, fire, earthquake, flood, epidemics, acts of government, agencies or officers, volcano, volcanic ash, natural calamities, or any other legitimate cause restraining performance of services.
    11. Winners shall provide all documents that are normally required to be provided for booking a flight ticket, in the same manner as any customer of the Carrier. Winners are also required to sign the Booking Form, Terms and Conditions and any other document of the Carrier which are applicable to the Prizes and other required documents as per the Carrier's KYC norms. The Carrier shall be free to decline bookings if the said requirements are not satisfied and cancellation charges shall apply as per the terms and conditions applicable to the trip.
    12. This Offer is valid for limited inventory and subject to availability at the time of booking.
    13. The Carrier and Flipkart reserve the right at any time to change, modify, withdraw, extend or terminate this Offer at their discretion, without any prior notice and without any liability or obligation in this regard.
    14. This Offer cannot be clubbed with any other promotion/discount of the Carrier.
    15. Any query regarding the Offer will be entertained only till June 30, 2017 by Flipkart. Post such date, Flipkart will not entertain any correspondence or communication regarding this Offer from any persons and the same will have to be directed towards the Carrier.
    16. You are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
    17. The Carrier and Flipkart reserve the right to disqualify You from the benefits of this Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under this Offer.
    18. Flipkart shall not be liable for any failure by the Carrier to provide Offer benefits/ Prizes to the Winner. The Carrier shall indemnify and hold Flipkart harmless against any claims by the Winners in this regard.
    19. You hereby agree to indemnify and keep Flipkart and the Carrier harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by Flipkart as a consequence of (i) violation of terms of this T&C by You; (ii) violation of applicable laws by You; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
    20. This Offer is not applicable to customers from the State of Tamil Nadu.
    21.
