Terms and Conditions (Flipkart Camera)

1. This feature (“Flipkart Camera”) is available on the Flipkart mobile application owned and operated by Flipkart Internet Pvt Ltd (“Flipkart”).
2. By accessing the “Flipkart Camera” feature or providing your information, You (“User/You”) give consent to process your personal and sensitive personal information as per our Terms of Use, Privacy Policy and these Terms and Conditions.

3. Please note that the “Flipkart Camera'' feature uses a third party camera kit as well that may collect personal information about you. For example, the Flipkart Camera feature uses Camera Kit which is provided by Snap Group Limited (Snap Inc.). By continuing to use the “Flipkart Camera feature” you agree to Snap Inc. Terms of Service and Privacy Policy including any updates thereto, by which the feature is governed. Flipkart does not review, monitor, approve, endorse or interfere with respect to processing and usage of the information provided by you to them. Flipkart holds no liability or responsibility with respect to your use of Camera Kit.

4. Please note that the “View in your Space'' feature also uses Scene Viewer powered by Google Play Services for AR and 3D, which is provided by Google LLC (“Google”) and governed by the Google Privacy Policy. By continuing or accessing the “Camera Kit” feature, You give consent to Google to use your camera from your mobile device. Your images captured or saved will neither be stored, processed or shared by Flipkart. Flipkart holds no liability or responsibility with respect to your use of Scene Viewer.

5. The ‘Flipkart Camera’ feature is not intended for use by persons under the age of 18 years. If You are under 18 years old, You should not use the “Camera Kit” feature or provide us with any personally identifiable information. If You disclose any personal information relating to other people to us, You represent that You have the authority to do so and to permit us to use the information in accordance with these terms and conditions and our Privacy Policy.
6. We may track your buying behaviour, preferences, and other information that You choose to provide on our Platform. We use this information to do internal research on the feature, demographics, interests, and behaviour to better understand, protect and serve our users. This information is compiled and analysed on an aggregated basis. This information may be shared with our third-party agents for analysis and for enhancing your “Flipkart Camera” experience. 7. The “Flipkart Camera” feature is provided solely for the User’s convenience to assess suitability of the concerned products and does not constitute any advice or expertise. The User is responsible for ensuring the product they purchase is suitable for their specific requirements. Flipkart has no visibility as to the suitability of the product and Flipkart shall not be held responsible for any product purchased by the User based on the “Flipkart Camera” feature.
8. Flipkart does not endorse the products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products, which shall be at the sole liability and responsibility of the sellers.
9. The “Flipkart Camera” feature is to be used as a guide. User agrees and acknowledges that there is no guarantee with respect to the accuracy, adequacy or completeness of the respective products and their suitability, actual colours, size, material and design may vary. Flipkart will not be responsible for any colour, size, material, suitability, or design differences in the actual product. In purchasing the products, User undertakes the risk that there may be a variation in the actual colour, size, material, suitability and design. Further, Users should note that the shop feature experience under "Flipkart Camera" is available only in AR Core supported devices which are compatible with the Google Scene Viewer. AR Zone feature will be available to all the Users and experience may vary from device to device.
10. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, THE CAMERA FEATURE IS PROVIDED BY FLIPKART “AS IS” AND FLIPKART HEREBY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE FEATURE OR ANY PORTION THEREOF, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. FLIPKART GIVES NO WARRANTY OR UNDERTAKING IN RELATION TO THE DISPLAY OF PRODUCTS OR OTHER INFORMATION, INCLUDING IN RELATION TO THE CAMERA FEATURE DISPLAYED ON THE PLATFORM. FLIPKART DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE “FLIPKART CAMERA ” FEATURE WILL MEET USER’S REQUIREMENTS, OR THAT THE FEATURE WILL BE UNINTERRUPTED, ACHIEVE ANY INTENDED RESULT, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, OR BE ERROR FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.
11. Flipkart reserves the right at its sole discretion, to terminate, withdraw, suspend, amend, extend, modify, add or remove portions of “Flipkart Camera” feature, at any time without any prior written notice.
12. You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Flipkart shall not be responsible in any manner.
13. You are not bound in any way to use the “Flipkart Camera” feature. Any action towards using the “Flipkart Camera” feature is voluntary.
14. You hereby agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by Flipkart as a consequence of (i) violation of terms of these Terms and Conditions by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in wilful misconduct or negligence on Your part.
15. In case of any dispute or difference arising concerning these terms and conditions, the same shall be under the exclusive jurisdiction of the courts in Bangalore, Karnataka.
16. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
