Terms & Conditions for Customers
1)The Customer understands and acknowledges that this product shall be delivered with an application which shall, on occurrence of events such as delay or non-payment of loan EMIs or breach of the loan agreement signed between The Customer and the lender, automatically activate the “Eligible Product functionality restriction” by disabling the use of the product. Customer confirms that he/she has read and understood the terms of sale and agrees to the foregoing condition being mandatory for purchase of this product.
2) Eligible Product shall mean Samsung Smart Televisions and other panel Eligible Products as authorized by Samsung shall be delivered with a Smart TV application (Samsung Smart Upgrade).
3) Smart TV application (Samsung Smart Upgrade), on occurrence of events such as delay in payment, irregular internet connection on TV, product repair/reset/denial of software service/software update will activate the Eligible Product functionality restriction by disabling the use of the Smart TV except ability to change internet settings on TV.
4) Incase Eligible Product functionality restriction is due to non-payment of pending dues then there may be some gap in actual payment due date and actual activation of Smart TV functionality restriction.
5) Smart TV application (Samsung Smart Upgrade) requires periodic internet connection on TV for smooth operation of product, hence dismissible and non-dismissible screens with messages will show on TV to connect internet whenever required.
6) Periodic payment reminders and necessary alerts will be shown on TV and mobile to users.
7) Internet on TV is mandatory required to deactivate the Eligible Product restriction functionality for normal viewing incase no dues are pending.
8) Customer support engineer, installation/setup engineer must be allowed to visit TV installation location and use own hotspot in case of no internet or given remote access to install Smart TV application (Samsung Smart Upgrade) while accepting Smart TV T&Cs by user or engineer on behalf of user. This is applicable to new purchase or repair of Smart TV purchased with Smart TV application (Samsung Smart Upgrade)
9) Smart TV application (Samsung Smart Upgrade) may send only Eligible Product information over internet to TV Guard server which is useful to maintain Eligible Product health check and continue enjoying non-stop entertainment.
10) Payment for pending dues must happen from “partner” (shall mean Flipkart) mobile app/web portal.
11) Customer/customer agrees that the Eligible Product or its components once purchased cannot be transferred or resold to another customer independently without prior notice and acceptance by Flipkart and its participating financing partners during pending deferred payment dues of Samsung Smart Upgrade.
12) Customer/customer agrees and acknowledges that the product is sold independently by Flipkart in association with its participating financing partners subject to the terms and conditions of sale, and that OEM shall not be liable for any claim, loss or damage, whatsoever, arising in connection with the said sale, financing or Eligible Product functionality restriction.
