    TERMS & CONDITIONS (Ixigo and Gaana.com Offer)

    A - PRELIMINARY

    1. This is a promotional offer ("Offer") being run on com ("Website") on Flipkart Mobile App, Flipkart Lite Platform (collectively "Platform"), which Platform is owned and operated by Flipkart Internet Private Limited ("Flipkart"). Under this Offer, Participants will be receiving Cashback Coupons from Le Travenues Technology Pvt Ltd ("IXIGO") and one month subscription of Gaana+ from Gamma Gaana Ltd. ("Gaana.com") as detailed hereunder.

    2. By participating in this Offer, user ("You", "Your" or "Participant") agrees to be bound by the following:

      • the Offer terms and conditions below ("T&C");
      • the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
      • the Terms of Use, Privacy Policy and all applicable terms & conditions of IXIGO published on the website https://www.ixigo.com/ ("IXIGO Website").
      • the Terms of Use, Privacy Policy and all applicable terms & conditions of Gaana.com published on the website http://gaana.com/ ("Gaana.com Website").

    B - OFFER DETAILS

    1. This Offer will commence at 00:00 hrs on June 24th, 2017 and end at 23:59 hrs on June 26th, 2017 ("Offer Period").

    2. To participate in this Offer You must to do/ fulfil the following:

      • Age must be 18 years or above;
      • Must have a valid account on the Platform, log into the same and shop for products under one of the following categories: Men's Clothing, Women's Clothing, Kid's Clothing, Kid's Footwear, Baby Care & Supplies, Baby Gear, Men's Footwear, Women's Footwear, Sports & Fitness, Watches, Sunglasses, Bags & Backpacks, Leather & Travel Accessories, Beauty & Grooming, Fragrances & Perfumes, Wellness, Jewellery, Books, Musical Instruments, Music & Videos, Office Supplies, Food & Nutrition ("Products") during the Offer Period; and
      • Total transaction value (net of returns and cancellation and any bank offers/PhonePe Offer) of Your purchases of the Products during the Offer Period must be equal to or exceed Rs. 1500.

    3. The participants fulfilling the above requirements ("Eligible Participant/s") shall receive the following Prizes:

    6. You can place multiple orders during the Offer Period which add up to over INR 1500 and avail the Offer. However, only on the first instance of the participants fulfilling the Offer requirements during the Offer Period shall receive the Prizes which can be redeemed in the manner set out in and subject to T&C.

    7. Prizes shall be issued against the first order of Rs. 1500 (single or broken) of the Product on the Platform to a unique phone no. and the email ID.

    8. The Eligible Participants shall receive their Prizes and related details in their registered email id on or before August 15th, 2017.

    C – IXIGO CASHBACK COUPONS – REDEMPTION TERMS

    1. The IXIGO Cashback Coupons are valid for redemption till September 30th, 2017 (before 23:59 hours).
    2. To redeem the Coupon, Eligible Participant must enter the unique e-coupon code received via email on the IXIGO Platform.
    3. You will receive your IXIGO cashback in your Citrus Wallet within 30 days of booking of flights, which can also be transferred to your bank account. For more details visit - https://www.Ixigo.com/cashback.
    4. A Coupon cannot be clubbed with any other ongoing offer discount/cash back/promotion run by IXIGO on IXIGO Platform. The International Flights Coupon is not valid on multi city flights. These flights are booked through multi-city tab on website.
    5. In case of full/partial cancellation, the Coupon applied will stand cancelled and void by IXIGO.
    6. Offer is not applicable on payments made through My Wallet, 3rd party wallets, payback points, COD, Pay Pal, EMI.
    7. IXIGO is the final authority on the interpretation of these Redemption Terms.

    D - GAANA+ SUBSCRIPTION COUPON– REDEMPTION TERMS

    1. Gaana+ is a premium subscription service from Gaana.com. Gaana+ users are allowed to download unlimited songs on mobile devices.

    3. Gaana+ Subscription Coupon can be used by new or existing Gaana.com users. Those not registered on Gaana.com will need to register themselves before availing the Gaana+ Subscription Coupon.
    4. To apply the Gaana+ Subscription Coupon, open the Gaana website/ App (Android ) > Settings > Redeem Coupon>Enter Coupon Code. For iOS please use the link ( https://gaana.com/settings/redeem) to redeem the Gaana+ Subscription Coupon.
    5. Gaana+ service is only available on Web, iOS & Android platforms.
    6. Gaana+ Subscription Coupon shall be valid for first come first serve basis. Gaana+ Subscription Coupons can be redeemed on Gaana.com till September 30th 2017. Unclaimed Gaana+ Subscription Coupons stand no value post this period.

    E -OTHER TERMS AND CONDITIONS

    Eligible Participants must reach out to IXIGO's customer care executive at cashback@ixigo.com/ and Gaana's customer care executive at feedback@gaana.com in case of any queries/ concerns in relation to fulfilment/ redemption of Prizes. Eligible Participants must reach out to Flipkart's customer care executive at https://www.flipkart.com/helpcentre in case of any queries/concerns in relation to disbursement of IXIGO codes/ PIN on or before September 30, 2017.

    1. All statutory taxes (direct or indirect, including local levies, TDS, registration fees, Insurance) on the Offer shall be payable by the Participant. IXIGO/Gaana.com or Flipkart will not be responsible / liable for the same.
    2. This Offer is subject to the prevailing laws of India.
    3. All decisions pertaining to the selection of Eligible Participants for this Offer are at the discretion Flipkart only.
    4. Prizes shall not be cancelled or exchanged for cash.
    5. IXIGO/ Gaana.com and/ or Flipkart shall not be liable for any loss or damage arising due to force majeure events including but not limited to Acts of God, acts of civil or military authorities, acts of public enemy, terrorist attacks, war, threat of war, destruction of network, strikes, lock-out, riots, civil disturbances, political disturbances, insurrections, accidents, explosions, fire, earthquake, flood, epidemics, acts of government, agencies or officers, volcano, volcanic ash, natural calamities, or any other legitimate cause restraining disbursement or fulfilment of Offer benefits.
    6. IXIGO/ Gaana.com reserves the right, at any time, without prior notice and liability and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions for utilisation of Prizes or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether. You are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
    7. IXIGO/ Gaana.com and Flipkart reserve the right to disqualify You from the benefits of this Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under this Offer.
    8. IXIGO/ Gaana.com and Flipkart shall not be liable towards any indirect, punitive, special, incidental or consequential damages arising out of or in connection with the Offer.
    9. For any debit or credit card related issues including net banking or such other modes of payment, You shall approach the authorized Bank. IXIGO/ Gaana.com and/ or Flipkart shall not be liable to entertain any claims in this regard.
    10. Any liability with respect to functioning of IXIGO/ Gaana.com codes/ PIN pertaining to the Cashback Coupons/Gaana+ Subscription Coupons which arises after disbursement shall be the sole responsibility of IXIGO/ Gaana.com and not Flipkart. Flipkart shall not be liable for any claims in this regards and all such claims must be directed to IXIGO.
    11. In no event the entire liability of IXIGO/ Gaana.com and/ or Flipkart under this Offer shall exceed the amount equivalent to the value of the Cashback Coupons/Gaana+Subscription Coupons which an Eligible Participant is entitled to under this Offer.
    12. Disputes, if any, arising out of or in connection with these offers shall be subject to the exclusive jurisdiction of the competent courts in Bangalore.
    13. You hereby agree to indemnify and keep IXIGO/ Gaana.com and/ or Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by IXIGO/ Gaana.com and/ or Flipkart as a consequence of: (i) violation of terms of this T&C by You; (ii) violation of applicable laws by You; (iii) any action or inaction resulting in wilful misconduct or negligence on Your part.
    14. This Offer is not applicable to customers from the State of Tamil Nadu.
