TERMS AND CONDITIONS FOR NO COST EMI ON HDFC BANK CREDIT CARDS (‘BANK CREDIT CARD’)

• I understand that under this offer, I will get an upfront discount equal to the EMI interest cost charged by the bank, making it effectively no interest cost.
• This Offer is applicable only on select products only on Mobiles, Large, Electronics and Travel Categories.
• This Offer is only valid from 19th October 2022 till 31st October 2022.
• This Offer is only applicable on six months (6) months EMI options.
• Applicable taxes on Interest and any other charges will be levied by the issuer.
• Under this offer payment through Bank Credit Card can be made for multiple products (eligible for the offer) selected in a single cart provided (i) the selected tenure for all such selected eligible products is the same (6 months) and (ii) the total sale price of such selected eligible products (net of discount applied) in the cart is more than or equivalent to Rs 3,000 (Three Thousand Only)
• The discount under this offer will be applicable on opting for the No Cost EMI on Credit Card option on payment page
• The discount under “No cost EMI” on Credit card “payment option is being offered exclusively by sellers and does not amount to EMI/Interest waiver extended by the bank.
• I understand that this offer is available on select products sold by select sellers only. This offer is valid till stocks last or the offer ends. Final Price is inclusive of the offer
• I understand that that under this offer there can be only one transaction per credit card
• I understand and confirm that I will need to pay applicable EMI and interest on the total value of the order at the time of payment to the bank in accordance with the terms and conditions applicable to the credit card. The interest cost charged by the bank overtime is being given back to me upfront at the time of this purchase and netted off in the invoice amount
• The discretion to allow the payment lies with the bank issuing the credit card. Flipkart will have no obligations or liability in the event the bank refuses to process the transaction for any reason
• The bank charges annual interest rates according to reducing monthly balance. In the monthly reducing cycle, the principal is reduced with every EMI and the interest is calculated on the outstanding balance
• I understand that if i fail in timely payment of EMI there may be additional interest/penalty that may be levied by the bank which may be higher than the discount offered under this scheme.
• Any returns/cancellations will be per Flipkart returns/cancellation policy. In case of any kind of return/refund in an EMI transaction interest already billed in a particular transaction will not be refunded in any circumstances.
• Flipkart will not be charging a processing fee for availing EMI option Bank may however, charge processing fee or cancellation charges as per the bank policies. Such charges will be paid by me and will not be refundable even in the event of return/cancellation of order
• You may check with respective banks/issuer on how a cancellation, refund or pre closure could impact the EMI terms and what interest charges would be levied on you for the same
• Flipkart retains the rights to modify or cancel this scheme at its sole discretion.

Preliminary

• This offer (Offer) is being run by Participating Sellers (‘Sellers’’) www.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively Platform), which is owned and operated by Flipkart Internet Private Limited (Flipkart, We or Our). It is open to all residents of India holding a valid and current HDFC Bank Credit Card (“HDFC Card” or “Bank Credit Card”), referred to as “Cardholders”
• By participating in the Offer (defined below), Cardholder agrees to be bound by:
• The Terms of Use, Privacy Policy and other relevant documentation including any modifications alterations or updates thereof, that are published on the Platform;
• All applicable terms and conditions of the Seller(s)

Offer Details

• Under this Offer, Cardholders may be eligible to get a discount equal to the EMI interest cost charged by the bank, making it effectively “No Cost EMI” during the Offer Period, using their Card (“Offer”). Cardholders are required to check the product page and the Offer applicability on the Eligible Products before completing their purchases.
• In case partial payment is made through a Flipkart Gift Card, Offer will apply only on the amount paid through the Card against the purchase of Eligible Products.

Other Terms and Conditions

• This Offer is NOT applicable on transactions made through Internet Banking/ PhonePe payment option. The Offer is not applicable for Cash-on-delivery transactions.
• In case of cancellation of your order, the transaction will not qualify for the Offer. If you cancel part of your order, you will qualify for the Offer only on the net amount you pay based on eligibility.
• Sellers(s) or Flipkart reserve the right to disqualify the Cardholder(s) from the benefits of the Offer if any fraudulent activity is identified as being carried out for availing the benefits under the said Offer or otherwise by use of the Card.
• Any person availing this Offer shall be deemed to have accepted these terms and conditions.
• Sellers and Flipkart reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
• Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary, and the Offer is being made purely on a best effort basis.
• Nothing herein amounts to a commitment by Sellers to conduct further, similar or other offers.
• Any query regarding the program will be entertained only till the offer lasts. Post such date, Sellers and Flipkart will not entertain any correspondence or communication regarding this Program from any persons.
• The Offer is a special offer for Credit Card holders only and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement of the Card Holders with HDFC Bank.
• Flipkart does not endorse any of the products or brands being offered under the Offer and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability to sellers on the Platform.
• All the existing offers, gifts, discounts etc. that are being offered can be availed by the Cardholders as part of the Offer as mentioned in the communication.
• Products offered under this program are subject to availability from the respective participating merchants/sellers on the Platform and accordingly Flipkart in no circumstances shall be liable for non-availability of any of the products.
• Under no circumstance will the Discount being offered under this Offer be settled with cash in lieu by Sellers or by Flipkart.
• Returned transactions, disputed or unauthorized /fraudulent transactions will not be considered for the Offer
• By participating in this Offer you agree to be bound by these terms and conditions of the Offer, standard terms and conditions, terms of use, privacy policy (subject to change) of the Platform and the terms and conditions of respective sellers shall be applicable on the Cardholder.
• The Cardholder shall indemnify and hold Flipkart, and/ or seller(s) harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorneys fee) that may be suffered by Flipkart, and/ or seller as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) published on the Platform, by Cardholder; (ii) violation of applicable laws by Cardholder; and (iii) any action or inaction resulting in wilful misconduct or negligence on the part of the Cardholder.
• All government Levies like GST, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Offer.
• This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
• All liability with respect to the products purchased on the Platform lies with the respective sellers and Flipkart shall be in any way responsible for the same.
• This Offer is valid only in India.
• This document is an electronic record in terms of Information Technology Act, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, this electronic record is generated by a computer system and does not require any physical or digital signatures.
• This offer cannot be clubbed with any other offer of Flipkart.
• Flipkart and Sellers are the sole authorities for interpretation of these terms.
• In no event the entire liability of Flipkart and Sellers under this Offer shall exceed the amount of promotional discount under this Offer.
• Flipkart and Sellers shall not be liable for any indirect, punitive, special, incidental or consequential damages arising out of or in connection with the Offer.
• Sellers and its directors, officers, employees and agents shall not be liable to the customers receiving the benefits under the offer or any other person for any deficiency, delay, omission, default or failure in delivery of the benefits of the Offer or any related matter by any person.
• The failure of any electronic communications in relation to delivery and/or receipt of communication, postings and other notifications whatsoever; and any entry, posting, notification or correspondence that is lost, late, misdirected, intercepted, undelivered, rejected, blocked, deleted or otherwise not received for any reason whatsoever, as the case may be. Under no circumstances shall the inclusion of:
• any reward offered/related benefits under the Offer.
• any promotion, offer, product or service offered under the Offer or related to, be construed as an endorsement or recommendation of such benefit or product or service under the Offer by Sellers. No representation or warranty of any kind is given by Sellers, and there is no responsibility or liability of Sellers as to the benefits offered under the Offer and all liability of any kind whatsoever is excluded to the fullest extent permissible by applicable law.
• All risks associated with the use or benefits of the Offer are borne by the customers receiving the benefits under the Offer.
• Issuance of this Offer does not amount to endorsement of any goods or services. Flipkart shall not be liable for any missed services, quality, defect or deficiency in any goods or services.
• This Offer shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Offer.
