Screen Protection Plan - Terms and Conditions
Preliminary:
- 'Screen protection plan ("Program") is offered by Jeeves Consumer Services Private Limited ("Jeeves"), an affiliate of Flipkart Internet Private Limited ("Flipkart") (in partnership with Go Digit General Insurance Limited (" Digit")) the owner and operator of the e-commerce platform, www.flipkart.com, whether accessed through a mobile application or any other means ("Platform").
- This Program is being run in partnership with Digit, an entity registered with the IRDA. Digit will be the insurer which shall fulfill the settlement of the claim in the instances set forth below.
- This Program is available for subscription/purchase along with select products ("Covered Product") on the Platform sold by registered sellers. This Program is available only in select cities in India and in select pin codes. The address provided during the purchase of the Covered Product shall be checked for eligibility of the Screen Protection Plan. In case of change in address, only if such address is serviceable shall the Screen Protection Plan be serviceable ("Service Address").
- By purchasing the Program on the Platform, purchaser/customer ("You" or "Your") agrees to be bound by:
- these terms and conditions ("T&Cs");
- the terms of use, privacy policy, and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
- terms and conditions of Digit.
Program - Key Features
If You subscribe to the Program by paying a subscription fee specified to You, in the event of screen damage to your mobile phone, You shall have the option to choose either of the following:
- (i)repair in the case of accidental damage to the screen of the Covered Product from the nearest service center of Jeeves and refund the lower of: (i) the repair cost as mentioned in the invoice; and (ii) 20% of the Purchase Price of the Product;
- (ii)in the event that Jeeves is not able to undertake the repair/replacement of the screen, You shall be entitled to receive 20% of the Purchase Price of Your mobile phone as the claim for the screen damage caused to Your mobile phone. Such amount shall be paid to You as a result of the screen damage insurance policy taken by You with our partner, Digit as per the certificate of insurance issued by Digit to You.
- Digit shall be responsible for settlement of the claim amount to You.
- In the case of repair being undertaken by Jeeves for the Covered Product:
- Genuine spare parts used for repair of Covered Product.
- 15 days commitment to undertake the repair of the Covered Product.
- End to end paper-less transaction
B. In the case of claiming the insurance policy from Digit:
- You will receive 20% of the Purchase Price of Your phone without any negotiations and delays. Purchase Price in the Invoice shall be taken to process Your claim. No depreciation calculated on the Covered Product while processing Your claim.
- Such amount shall be credited in Your bank account within 72 hours of the claim being made.
- No deduction shall be made at the time of payout of the claim.
- The insurance policy is automatically activated from the time of purchase of the Program by You.
Defined Terms:
The following terms, when capitalized, if not defined elsewhere in these T&Cs shall have the meanings assigned to each such term below:
- Purchase Price: is purchase price of the Covered Product prior to any discounts but including applicable taxes as mentioned in the invoice to the Customer.
- Repair warranty: is a 90 day Repair warranty (from the date of repair done by Jeeves under the Program) on the repairs done on the Covered Product under this Program under which in case of recurrence of the repaired issue, Jeeves will repair such issue free of cost.
- SLA: SLA (service level agreement) is defined as the total time elapsed between the pick-up of the Covered Product from Your Service Address and the first attempt to deliver the repaired/replaced Covered Product at Your Service Address. The Program offers a 15 Calendar Days repair/replacement SLA to You and 72 hours for settlement of the claim to You.
- Invoice: The original invoice that has been issued to You by the retailer for purchase of the Covered Product.
- Calendar Days: Includes all 7 days (weekdays and weekends); excludes national & regional holidays.
Program Applicability/Non-applicability:
- Only Screen Damage is covered therefore any damage to your phone due to any liquid getting into the phone or any other accidental damage is not covered.
- Regular wear and tear of the phone.
- The phone being stolen or lost.
- Any Mechanical/Electrical Breakdown or Damage which is covered under manufacturer's warranty like if your touchscreen starts acting up suddenly (without you dropping it on the floor or in water) within the warranty period.
- Any loss of/damage to data and contents including pictures, software, downloads, apps, music or any other content.
- Any loss or damage to accessories including screen guards or ancillary product/s made available under any promotional scheme.
- Any damage to SIM card, Memory Cards or any other ancillary product.
- This Program is applicable only if , during the Program Coverage Term, the Covered Product:
- Suffers any physical damage to the screen
This Program is not applicable in either of the following cases:
- Any defect due to liquid entering the Covered Product;
- Any other accidental damage to the Covered Product;
- Any loss due to regular wear and the Covered Product;
- Any mechanical/electrical breakdown or damage which is covered under Manufacturer's Warranty. For eg. if Your touchscreen starts acting up suddenly (without you dropping it on the floor or in water) within the warranty period.
- Any loss of/damage to data and contents including pictures, software, downloads, apps, music or any other content.
- Any loss or damage to accessories including screen guards or ancillary product/s made available under any promotional scheme.
- Any damage to SIM card, Memory Cards or any other ancillary product.
Program – Details & Steps to be followed:
In the event of a claim request under the Program, You are required to do the following:
- Intimate Jeeves about the claim request and the nature of damage of the Covered Product along with the cause or reason of the damage at 1800 425 5568 or 080-25187326 and provide other relevant information required by Jeeves (including details in relation to the incident which caused the screen damage).
- You shall be required to provide an alternate mobile number on which a self-assessment video will be sent, along with a request for Your bank account details.
- You shall be required to choose either of the following: (i) get Your Covered Product repaired at a service center of Jeeves; or (ii) make a claim for refund of 20% of the Purchase Price of the Covered Product from Digit;
- In case, the customer chooses Option (i) set forth above, the details of the nearest service center will be provided. You can visit the nearest service center and get the Covered Product repaired.
- After getting the Covered Product repaired, You can still claim the repair cost from Digit, subject to a maximum of 20% of the Purchase Price of the Covered Product. You will have to pay the repair amount upfront at the repair, post which You will need to call 18004255568 or 080-25187326 to claim 20% of the Purchase Price of the Covered Product.
- If the claim is approved once the repair is undertaken or upon the customer choosing Option (ii) above, a payment of 20% of the Purchase Price of the Covered Product is undertaken by Digit within 72 hours of placing the request. The claim shall be approved at the sole discretion of Flipkart and Digit.
Other terms and conditions:
- In case of further sale or gift of Your Covered Product, You shall inform such ownership transfer within 7 days of such transfer by calling Jeeves customer support at 1800 425 5568 or 080-25187326. Responsibility of informing Jeeves and transferring the Program rests upon You/ original beneficiary. Post KYC validation of original beneficiary, the Policy will be transferred to the new beneficiary.
- The Program, once purchased, can be cancelled only within 10 days of product delivery provided there is no claim raised. Upon cancellation of the Program, the entire purchase price will be refunded.
- Jeeves may subcontract the services provided under the Program without notice to You.
- Failure to perform any of the steps mentioned in the T&Cs, will result in cancellation of all benefits vis-a-vis the particular Claim and Jeeves and Digit will not be responsible for any loss or claims that You may have in this regard.
- By purchasing the Program, it would be deemed that You have given Your consent to contact you through call, SMS or email on the details provided by them for the purpose of this Program.
- Jeeves will provide warranty for the repair undertaken for a period of 90 days from the date on which the repair was undertaken. Jeeves will not be responsible for any loss that You may incur as a consequence of utilizing the benefits under the Program.
- Digit shall be responsible for refund of the amount to You and Jeeves shall not be liable for the same.
- You acknowledge and confirm that you are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorized persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Jeeves and Flipkart shall not be responsible in any manner.
- This Program is a contract between You and Jeeves and Digit in relation to the Program and Flipkart and seller/retailer of the Covered product is not/shall not be a party to the same and shall not be responsible for any of Your grievances with regards to the services to be performed by Jeeves under this Program.
- If any provision of these T&Cs shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions hereof shall not in any way be affected or impaired.
- You hereby agree to indemnify and keep Jeeves and/ or Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by Jeeves and/or Flipkart as a consequence of (i) violation of these T&Cs by You; (ii) violation of applicable laws by You; (iii) any action or inaction resulting in willful misconduct or negligence, on Your part.
- These T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&Cs.
- This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
- The Program is valid only within the territorial limits of India.
