This Privacy Notice describes how Shopsy collects, uses, shares or otherwise processes your personal data through the Shopsy mobile application, (hereinafter referred to as the “Platform”). Flipkart Internet Private Limited owns and operates this Platform. For the purposes of this Privacy Notice, is defined as any data about an individual who is identifiable by, or in relation, to such data (“Personal Data”). By visiting this Platform, providing your information or availing our product/service, you expressly agree to be bound by the terms and conditions of this Privacy Notice, the Terms of Use and the applicable service/product terms and conditions, and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use or access our Platform.
This Privacy Notice applies to all customers and all other users who interact with us through the Platform or who interact with us through any other mode or channel, including but not limited to customer support channels, chat and voice bots, video commerce, surveys, feedback forms, promotional events, social media pages, loyalty programs, affiliate programs contests, marketing campaigns, and any other online or offline interactions with us (“you”, “your”, “user(s)”). This Privacy Notice covers your personal data whether it is collected directly in digital form or collected in non-digital form and subsequently digitized by us in accordance with the laws applicable in India including Digital Personal Data Protection Act and applicable rules thereunder (Applicable Laws).
While you can browse sections of the Platform without the need of sharing any Personal Data with us, however, please note we do not offer any product or service under this Platform outside India and your Personal Data will primarily be stored and processed in India.
Grounds for Processing your Personal Data
We process your Personal Data on the basis of your consent, in accordance with applicable data protection laws. In certain circumstances, we may also process your Personal Data on other lawful grounds permitted under applicable data protection laws such as legitimate use (e.g., where you voluntarily provide your Personal Data to us).
Sources of Collection of your Personal Data
We collect Personal Data about you either directly or indirectly:
- When you create, update, or manage an account or otherwise provide Personal Data in connection with any transactions on the Platform;
- When you post reviews, ratings, feedback, comments, images, or otherwise voluntarily provide Personal Data on the Platform;

Collection of Your Personal Data
Once you give us your Personal Data, you are not anonymous to us. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide Personal Data by choosing not to use a particular service, product or feature on the Platform.

Cookies
We use data collection devices such as "cookies" on certain pages of the Platform to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety. We offer certain features that are only available through the use of a "cookie". We also use cookies to allow you to enter your password less frequently during a session. Sharing of Personal Data
We may share your Personal Data with Flipkart group companies including Flipkart Advanz Private Limited, Flipkart Finance Private Limited, Scapic Innovations Private Limited, and other Flipkart affiliates, related companies, including Credit Bureaus and business partners (such as UPI platform), for purpose of providing products and services offered such as when you opt for personal loans, UPI.
Additionally, we may also disclose your Personal Data to third parties, such as our sellers, business partners, and service providers for
- with vendors to perform services on our behalf. These vendors include, without limitation, shipping vendors, billing and refund vendors, payment card processors, and companies that help us improve our products and services.
- Flipkart Marketplace and Other Direct-to-Customer Companies: We work with a number of companies that provide services directly to you, either through our Marketplace or through co-branded and other promotions. When we share your Personal Data with these companies, they are prohibited from using it for any purpose other than making their products or services available to you.
- Advertising, Marketing, and Other Related Technology Partners: We work with various advertising, marketing, and other related technology partners so we can both market our products to you and provide advertising services to other companies.
- Publishers. These are companies that operate the websites that you visit. We share Personal Data with publishers to help us serve ads to you on their websites and to help us understand how those ads perform.
- Social Media Platforms. We share personal information with social media platforms that help us serve ads to you on those platforms.
- Advertising Technology Providers. We work with companies that use cookies, pixels, beacons, and similar technologies to tailor the ads you see using information collected about you over time on our Platform, and across other participating websites and mobile services. Advertising Technology Providers include ad servers, advertising agencies, technology vendors that support media buying and selling, and research firms.
- Data Technology Vendors. We work with technology providers that help us manage and automate the use of the data we collect (including personal information). These companies include, for example, technology providers that help us automate our advertising services, and identity management companies.
- Measurement and Analytics Vendors. These vendors include, for example, companies that provide aggregate reporting on our website performance, and the effectiveness of our advertising campaigns and services.
We may disclose Personal Data if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose Personal Data to law enforcement agencies, government and regulatory authorities, third party rights owners, or other authorities in the good faith belief that such disclosure is reasonably necessary to enforce our Terms of Use or Privacy Notice; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public; or to comply with any legal or regulatory process.
We and our affiliates will share / transfer some or all of your Personal Data with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or reorganization, amalgamation, restructuring of business. Should such a transaction occur, that another business entity (or the new combined entity) will be required to follow this Privacy Notice with respect to your Personal Data.
Links to Other Sites
Our Platform may provide links to other websites or applications that may collect Personal Data about you and you will be governed by their privacy policies. Flipkart shall not be responsible for the privacy practices or the content of their privacy policies, and we request you to read their privacy policies prior to disclosing any information including any Personal Data.
Security Precautions
We maintain reasonable physical, electronic and procedural safeguards to protect your information in accordance with Applicable Laws. Whenever you access your account information, we offer the use of a secure server. Once your Personal Data is in our possession, we adhere to our security guidelines to protect it against unauthorized access. However, by using the Platform, the users accept the inherent security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure, and therefore, there would always remain certain inherent risks regarding use of the Platform. Users are responsible for ensuring the protection of login and password records for their account.
Choice/Opt-Out
We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications after setting up an account with us. If you do not wish to receive promotional communications from us by reaching us through toll free number or support@shopsy.in
Advertisements on Platform
We use third-party advertising companies to serve ads when you visit our Platform. These companies may use information (not including your name, address, email address, or telephone number) about your visits to the Platform and other websites in order to provide personalized advertisements about goods and services of interest to you. You have an option to opt out from tracking of personalized advertising using the “Opt out of Ads Personalization” settings using your device’s settings application. Flipkart will have no access to your GAID once you select this feature.
Personal Data of Children
Use of our Platform is intended only for individuals who are 18 years of age or older and can form a legally binding contract under the Indian Contract Act 1872. Flipkart does not offer products or services for purchase by children; while we offer children's products, these are for purchase by adults only. We do not knowingly solicit, collect or process Personal Data from children who are under the age of 18 years.
Data Retention
We retain your personal data in accordance with Applicable Laws, for a period no longer than is required for the purpose for which it was collected or as required under any Applicable Law. However, we may retain data related to you if we believe it may be necessary to enable Flipkart to exercise its legal rights and/or defend against legal claims or if required by law. We may continue to retain your Personal Data in anonymised form for analytical and research purposes.
Your Rights
We take every reasonable step to ensure that your personal information that we process is accurate and, where necessary, kept up to date, and any of your personal information that we process that you inform us is inaccurate (having regard to the purposes for which they are processed) is erased or rectified. You may access, correct, and update your personal information directly through the functionalities provided on the Platform. You may delete certain non-mandatory information by logging into the Application and visiting Profile and Settings sections.

You have an option to withdraw your consent that you have already provided by writing to us at the contact information provided below. Please mention “for withdrawal of consent” in the subject line of your communication. We will verify such requests before acting upon your request. Please note, however, that withdrawal of consent will not be retroactive and will be in accordance with the terms of this Privacy Notice, related Terms of Use and applicable laws. In the event you withdraw consent given to us under this Privacy Notice, such withdrawal may hamper your access to the Platform or restrict provision of our services to you for which we consider that information to be necessary.
Changes to this Privacy Notice:
Please check our Privacy Notice periodically for changes. We may update this Privacy Notice to reflect changes to our information practices. We will alert you to the changes of this Privacy Notice and where there is any change in relation to the processing activities in relation to your Personal Data, by posting the date our Privacy Notice last got updated or by sending you an email when we are required to do so by Applicable Law. We also recommend that you review this Privacy Notice periodically to ensure that you are aware of the current privacy and data protection practices of Flipkart.
