TERMS AND CONDITIONS FOR SMARTPACK PROGRAM (Valid between May-11 2021 to May-14 2021):

The following are the terms and conditions for the Flipkart SmartPack plan operated by Jeeves Consumer Services Private Limited, here in after referred to as "Jeeves", incorporated under the Companies Act, 1956 and having its Corporate office at Buildings Alyssa, Begonia & Clover, Embassy Tech Village, Outer Ring Road, Devarabeesanahalli Village Bengaluru, Karnataka, 560103. The program is operated on the platform (www.flipkart.com)/ Flipkart M App/ Flipkart Lite Platform ("Platform").

Preliminary:

  • Flipkart SmartPack ("Program") is a program consisting of: (i) Flipkart SmartPack provided by Jeeves Consumer Services Private Limited ("Jeeves").The Program is available for purchase on the mobile application and/or M-site of Flipkart Internet Private Limited ("Platform"). This Program is not available on website of Flipkart. All the features, information, transactions can be referred/made through the mobile application and/or M-site only.
  • This program is available only on select products ("Covered Product") on the Platform sold by registered seller. This Program is available only in select cities in India and on select pin codes ("Serviceable Address").
  • This program shall be valid for a period of 12 months from the date of successful delivery of the mobile device with which the SmartPack is bought (“Device”) and provided the said Program is not cancelled by the customer post purchase.
  • Customer can purchase the Program along with the purchase of the primary product at Point of sale. In case of any discrepancy in modes of communication in any of the terms between these terms and conditions and any other mode of communication, the terms and conditions takes precedence over all such source, the terms set forth in these terms and conditions shall prevail.
  • In order to subscribe to this program, customer ("You" or "Your") needs to pay a specified subscription fees and will automatically be bound by:

    • these terms and conditions ("T&Cs");
    • the terms of use, privacy policy, and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
    • terms and conditions of Jeeves

Buy a smartphone with Flipkart SmartPack and get

Access to premium Services as provided in the Plan. Details of the Plan available under the Program are provided in the table below.

  • The Plan is available for 12 months.
  • Return your Device at the end of the 12 months tenure and get 100% Moneyback on the smartphone. Moneyback will be credited in customer’s bank account at the successful completion of the tenure.
  • Device can only be returned in working condition along with the Device charger & all Device accessories; Device should turn on and the IMEI number must be visible on the Device’s screen, it will be accepted for return. This is subject to check done at the time of the return.
  • Pay for your pack every month on Flipkart app using any payment method except Cash & EMI. You can also choose to cancel the pack in between the tenure, by forfeiting your access to all subscribed services and to the moneyback claim at the end of the tenure

      Flipkart SmartPacks are available in select Pin Codes only. Please check if it is available for your Pin Code. Certain services within the packs may not be available at all pin codes therefore overall pack options & prices may vary between different pin codes.

Flipkart endeavours to provide the best offering to customers at all times. Therefore, we may - update, add or remove plans from time to time with the latest available offerings and prices.

Flipkart SmartPack is not available on Desktop and can be viewed and bought from the Flipkart app or m-site only.

  • Plan Selection Related

    • Want to change the services in my pack

Currently, there is no option to change services in a pack.

    • Can I opt for a tenure other than of 12 months

No, you can buy SmartPacks with a 12 tenure option only.

  • Payment & Offer Related

    • How much do I need to pay for the plan & for the Device? (now and later)
      You need to pay full amount for the Device now along with the plan price for the first month. You will also have to pay the plan price as per the pack chosen by you every month for the duration of the tenure chosen by you in order to receive the moneyback against the Device amount at the end of the tenure.
    • What are the payment methods available for the payment of the plan and the Device.

You can pay for the Device & the first month pack fees using any payment method including Credit Card, Debit Card, Net Banking, Easy Monthly Installment, Electronic Gift Voucher & Cash on Delivery. Post that, you can pay for the pack every month using any payment method except EMI and Cash on Delivery.

    • Will PBO apply? What will be the percentage moneyback I will get in case a PBO was applied when I purchased the Device?

In case you purchased a Device with a Bank Offer, you will get a moneyback on the effective price you paid. For example:

Price of Device on Flipkart: Rs 10000

Applicable Bank Offer: 10% off on Credit Cards

Effective Price paid for Device: Rs. 9000

Plan Purchased: 100% Moneyback Plan for 12 months

Moneyback that will be credited after 12 months (if Device is returned in accordance with the terms and conditions under this document): Rs. 9000

    • How many coins will apply? Can I pay with coins?

You can pay with coins in case there is an offer available on the particular Device.

You will get the standard Coins offer that is live on the Flipkart Platform with your Device order. (Eg. Max. 100 coins for a given order).

    • How often do I have to pay for the plans? Is it one time payment or every month?
      You need to pay for the SmartPack every month till the end of the tenure to enjoy the uninterrupted access to the chosen Services as well as to be eligible for the promised Moneyback.
    • What happens if I stop paying or forget to pay for the SmartPack in between the tenure?
      In case you stop paying for the SmartPack in between the tenure, you will lose access to the subscribed services and you will not be eligible for any moneyback on the Device. All benefits under the Program including benefits of Complete Mobile Protection shall stand terminated with immediate effect.

In case you forget to pay for the SmartPack by the due date, we will send you a reminder to make the payment and will allow you to continue on the subscription by paying a late payment fee of Rs.100 within 19 days from the due date; your subscribed services will continue uninterrupted and your moneyback will not get impacted if you chose to do so.

  • Other Platform propositions

    • Can I Exchange my old phone while buying a new Device with Flipkart SmartPack?
      Yes, you can exchange your old phone and buy a new Device with Flipkart SmartPack. The value of your old phone will get adjusted against the upfront amount you pay for the new Device. Rest assured, at the end of the tenure, you will continue to get the moneyback on the full price of the new Device and not the reduced value.
    • Can I use Buyback Guarantee while buying a new Device with Flipkart SmartPack?
      Yes, you can use buyback guarantee of your old phone while buying a new Device with Flipkart SmartPack. The promised buyback guarantee amount of your old phone will get adjusted against the upfront amount you pay for the new Device. You will continue to get the moneyback on the full price of the new Device and not the reduced value.

E.g. if you buy a Device of Rs.10000 with a SmartPack of 100% moneyback, and use the buyback guarantee of your old phone of Rs.4000 while making this purchase, then you need to pay Rs. 6000 instead of Rs. 10000 upfront for the device along with the first month fees of the chosen SmartPack. You will continue to get Rs.10000 moneyback at the end of the tenure as per your eligibility. However, buyback guarantee program cannot be purchased along with the SmartPack Program at the time of purchase of new Device.

  • Services

    • What is the value proposition for these services?

You can find the value proposition for each service by tapping on the service from within the Pack.

    • I already have these services, can I club it?

For some partners your existing subscription will get paused or added on top of the subscription bought from flipkart. You can find out which Services support this feature by tapping on the Service icon from the SmartPack. Wherever this facility is not available, you can activate the subscription bought from Flipkart on a different activation id (mobile number of email id). Alternatively, you can speak to the service provider to pause or deactivate your existing service if possible and continue to enjoy the service through Flipkart. If Service is activated using same activation id where subscription is already active and where partners do not support pausing or adding on top of existing subscription, a parallel subscription will get created for the customer where both subscriptions will run in simultaneously.

    • When & How will my plan get activated?

You will be able to activate your plan once your Device is delivered. You can visit Flipkart SmartPack section from My Orders to view & activate all services you have subscribed to.

    • I have an existing subscription of some or all of these services. Can I still buy this pack?
      Yes, you can buy & activate the pack irrespective of whether you are a New or an Old user of these Services. However for some services, your SmartPack subscription may run in parallel to your existing subscription.
    • Can the service offering change in between the tenure?

Each service offering is managed by respective service provider only and is subject to change at any point of time. Flipkart will not be responsible or liable for any such change & Customer has to reach out to the respective provider directly only for grievance redressal for such concerns.

    • Usage of the Services

All the services under the Program shall be subject to their respective terms and conditions. Please refer to the terms and conditions of the individual Services of the Program for detailed understanding.

  • Service Activation & Usage

    • When will the services in my plan get activated?

All services in your plan can be activated after the delivery of your mobile Device. You need to provide details of email ID or phone number where you want the services to be activated, after placing your order. Once these details are provided, the services will automatically get activated on delivery of your mobile Device.

    • How do I activate the services?

You can access services in your Flipkart SmartPack by clicking on the Flipkart SmartPack Logo on My Orders.

On the Flipkart SmartPack Details Page, you can click on “Activate” or “Start Activation” to start activating your services. You will need to provide email and/or phone number details to be able to activate the service.

    • Service not available in my area

In case a given service is not available in your area temporarily, please contact the service provider regarding the same.

    • I am unable to use the service

In case a given service is not working or you are unable to use the same even though it has been activated on your Flipkart SmartPack, please contact the service provider regarding the same.

    • I want to pause the service

At the moment, we do not support a pause on your Flipkart SmartPack.

    • I want to change the account where service is activated

At the moment, we do not support changing the account on which a given service has been activated during the course of your Flipkart SmartPack.

    • Do I have to pay for services in advance?

Yes, Flipkart SmartPack is a prepaid construct. You will be paying the charges for the first 30 days of usage at the point of purchase of your Device. This will enable you to use the services for 30 days from the day of delivery of the services. Similarly, on a monthly basis, you will be able to use the services by paying for the same whenever a bill gets generated.

    • If I do not use a service, will I get a refund for it?

As part of Flipkart SmartPack, you have unlocked access to all services that are part of it. You can enjoy services during the tenure. There will not be a refund if you do not use a particular service in a given month.

    • Can I start the services before the Device gets delivered

No, Flipkart SmartPack services can be used only after the Device gets delivered. However, you can provide details of email ID or phone number where you want the services to be activated, after placing your order. Once these details are provided, the services will automatically get activated on delivery of your mobile Device.

    • Can I defer starting the services? Will I pay only when the service is activated

Flipkart SmartPack will be activated when the Device gets delivered. You will be charged based on a 30 day cycle from that day onwards. You can enjoy services from this point onwards. For the purpose of this program, one month equals thirty days and 12 months equals 360 days.

    • Can I choose where to activate the services? Will all services be activated on my flipkart mobile number or email id.

We offer the flexibility to activate every service on a email ID/phone number of your choice. For example, you can activate one service on abc@gmail.com and the next service on xyz@gmail.com. However, you will not be able to change these throughout the tenure.

    • Can I gift the services to a relative?

We offer the flexibility to activate every service on a email ID/phone number of your choice. For example, you can activate one service on abc@gmail.com and the next service on xyz@gmail.com. However, you will not be able to change these throughout the tenure.

    • Is there any difference in the services offered by Flipkart and by service provider?

All services on the Flipkart SmartPack are provided by the respective service providers. On each plan, you can check the benefits being offered by the respective service provider on the Plan Details Page of that particular plan.

    • Can I change the services in my plan in between the tenure?

No, you cannot change the services in your plan once it is chosen & bought.

    • Will my data be shared with service providers? What data will be shared? Can I choose not to share this data?

In order for our service partners to be able to render services on the Flipkart SmartPack, we need to share your personal information for them to activate the chosen services. Except for your name, mobile number, email ID and address/location on which you want the particular service to be activated, no other personal information are shared with the service partners. Without the same, we will not be able to activate services in your Flipkart SmartPack. Our service partners are subject to the terms between Flipkart and service partners which is no less protective than those set out in our Privacy policy. Flipkart does not review, monitor, approve, endorse or interfere with respect to processing and usage of the information provided directly by you to our service partners and Flipkart shall not be held liable for any breach.

  • End of Tenure

    • I want to give my Device back at the end of my plan tenure

Closer to the end of your Flipkart SmartPack, you will see an option on your Flipkart SmartPack details page that will enable you to return your Device back to us. You will need to share your bank account details for money back credit, pickup address and status of your Device. Once your Device gets picked up by a wishmaster, you will receive the money back credit in your bank account in 15 business days, subject to processing of transaction by the bank.

    • Device is broken or scratched

One of the benefits of Flipkart SmartPack, is that you can choose to return your Device as long as the Device switches on & we are able to verify your IMEI on the screen. Scratches or damages are covered under your plan. As part of raising your moneyback request, you can declare the state of your screen - whether it is broken or not. This will enable us to create a seamless pickup experience for you. Reporting that your screen is broken in no way, will impact the money back due to you.

    • What condition of the Device will you accept

One of the benefits of Flipkart SmartPack, is that you can choose to return your Device as long as the Device switches on & we are able to verify your IMEI on the screen. Scratches or damages are covered under your plan. As part of raising your moneyback request, you can declare the state of your screen - whether it is broken or not. This will enable us to create a seamless pickup experience for you. Reporting that your screen is broken in no way, will impact the money back due to you.

    • Do i have to give the Device box back

Yes, you shall have to give the Device box back during the Device return. In case the Device box is not returned, Rs.500 will be charged and/or deducted from the moneyback payout, as may be determined by Jeeves in its discretion.

    • Do I have to give the Device charger back

Yes, you shall have to give the Device charger & all Device accessories back during the Device return. In case the Device charger is not returned, Rs.300 will be charged and/or deducted from the moneyback payout, as may be determined by Jeeves in its discretion.

    • Do i have to show the Device bill also

It is not mandatory to share your Device bill while returning the Device. You can return your Device as long as the Device switches on & we are able to verify your IMEI on the screen.

    • Can I extend my plan or services in my plan

We currently do no support extending your plan or services in your plan beyond the plan tenure you had signed up for at the point of purchasing the Device.

    • Will I get any value for my Device at the end of the tenure over and above the promised 55% moneyback

You will get the committed %age moneyback as part of your plan when you return the Device back to Flipkart in accordance with the terms of the Plan.

    • Where will I get my moneyback

You will get the moneyback as part of your plan when you return the Device back to Jeeves. For example, if your Device was purchased on a 100% moneyback plan, you can return your Device to get 100% back on your Device price.

    • How much moneyback will you get (if you return Device, if you keep device, if you lose Device or if Device breaks)

You will get a money back of 100% of the device value at the successful completion of the Plan tenure and if you return the Device along with all accessories and subject to checks at the time of the return. In case the phone is lost / stolen in between the tenure and you have completed the tenure by paying subscription fees for all months, then you In case you keep your Device, you will not receive moneyback of your Device cost.

    • Can I receive the moneyback in a different account?

We will credit the money back in the bank account that is shared by you at the end of the tenure. Please validate the same. Moneyback once credited cannot be reversed. The Bank account must be an Indian bank account and compliant with KYC requirements. The Bank account must belong only to you only and not to anyone else. Jeeves in its own discretion may not transfer the moneyback amount, if the account details provided by you are suspicious and/or is likely to be engaged in unlawful activities and/or KYC compliance is not completed. Jeeves shall not be responsible for any transaction failures/deficiency in services at the end of the bank. Jeeves does not verify the account details at its end, if the details provided by you are incorrect/incomplete, Jeeves shall not be responsible for such transactions and/or shall not be liable for any claims from the customers. If Jeeves is unable to make the deposits in the bank account due to any reasons whatsoever, it may in its sole discretion choose to provide the moneyback through gift vouchers.

    • When do i have to return the Device

You can choose to return the Device in the last month of your plan tenure i.e. in your 12 month plan, you can choose to return the Device after month 11.

    • I have changed my location, can I still return my Device?

You can choose to return the Device from any address where Flipkart/Sellers of Flipkart offers device pickup or product exchange facility.

  • Plan Tenure

    • When do I need to pay my bill

You need to pay for your SmartPack bill every month as per the due date generated for the bill. The due date will be set for 20 days after the plan is first activated.

    • Payment modes available to pay bill

You can pay the bill using any payment method except Cash on Delivery & Easy Monthly Installment.

    • I am unable to pay my bill

Please ensure you are making the payment using a prepaid payment method and that you haven’t paid the bill already. Please contact Flipkart customer care if you are still not able to make the payment.

    • What if i dont pay my bill by the due date? Can I pay the bill after due date?

In case you forget to pay for the SmartPack by the due date, we will send you a reminder to make the payment and will allow you to continue on the subscription by paying a late payment fee within 19 days from the due date; your subscribed services will continue uninterrupted and your moneyback will not get impacted if you chose to do so. In case you do not pay the bill with the late fees in the 19 day grace period, your access to the services will be terminated and your whole moneyback amount will be forfeited.

    • Can I pay my Flipkart SmartPack monthly bill in advance

Unfortunately this facility is currently not available.

    • I did not pay my bill and services have been stopped

If your access to services has been revoked, then you have exceeded the grace period of 19 days provided to you to pay your SmartPack monthly bill. Because of this, your SmartPack plan has been deactivated and your Money Back has been forfeited. Unfortunately this cannot be undone.

    • Why is a late fees levied for me

You have not paid your monthly SmartPack bill by the due date therefore a late fees has been levied. You can continue your subscription to SmartPack by paying the bill with late fees. Rest assured, your Moneyback will not get impacted if you clear your dues.

  • Plan Cancellation

    • I want to cancel my plan after the return window is over

Unfortunately you cannot cancel the plan after the return window is over. You can enjoy the services in the pack for this month and choose whether to continue on the pack from next month.

    • I am unable to cancel my plan

You cannot cancel your plan if there is any bill due. You can cancel your plan once all dues have been cleared. Rest assured that you will continue to have access to your subscribed services for the period you have made the payment even after you have cancelled the plan.

    • Will I get partial moneyback if I cancel my plan

No, you will not get any moneyback if you cancel your plan.

    • Do i have to return the Device if i cancel my plan

No, you do not have to return your Device if you cancel your SmartPack plan.

    • I cancelled my plan by mistake, how i can i restart my plan

You can restart the plan within 24 hours from the time you cancelled it. Simply go to Flipkart SmartPack Section from My Orders and click on “Undo Cancellation”.

    • Is there any cancellation fees

No, there is no cancellation fees applicable.

  • Check out

    • My selected plan is not available any more

Jeeves endeavours to provide the best offering to customers at all times. Therefore, we may update, add or remove plans from time to time with the latest available offerings and prices. You can go ahead and choose any of the available options for Flipkart SmartPacks on the Device at that point.

    • The plan price has increased at check out

  • Device Return and Replacement

    • I want to return my Device, what happens to my plan?

Returning your Device depends on Flipkart’s return policy for that particular Device. In case, you choose to return your Device, your 100% Moneyback plan and all applicable services will be terminated too. Return of the Device must be made within the return period and as per the return policy of Flipkart.

    • I want to replace my Device, what happens to my plan?

In case you are facing some issues with your Device, you can go ahead and request for a replacement as per Flipkart’s Replacement Policy. You can continue enjoying services on your plan and the 100% Moneyback will be applicable on the replacement Device.

    • I want to return my plan but keep my Device

Unfortunately, you cannot return a plan alone once it is bought.

  • Complimentary Offer Coupons & Trial Codes

    • What are these coupons

These offer & trial codes are being given to you free of cost for subscribing to Flipkart SmartPack. These offers can vary every month. When & Where will i get these codes

You will receive the complimentary coupon codes in your registered email id by 15th of the next month from the month of purchase.

E.g. If you purchase SmartPacks on 3rd January, then you will get an email with the complimentary codes on or before 15th February.

    • I did not get the codes. What can i do?

Please check if you are eligible to recieve codes as per the timeline given in above point. If yes, please check your Promotions / Updates / Spam folder for the email or search for the email with the subject line: ‘Complimentary Coupons for your Flipkart SmartPack Purchase'.

    • I only received some of the coupon codes and did not receive all the coupon codes.
      You will receive all the codes in 4 different emails. Please check your inbox for the same. Please note offers and coupons may vary every month. You will receive the codes as per the offer that was running in the month of your purchase.
    • I deleted the email with the coupon codes by mistake

Please check your trash folder to retrieve the email.

    • How can i use these coupons & offers

You can use these coupon codes at the respective partner’s app / website or retail store as per the t&c mentioned against the offer. Please refer the Steps to Redeem and the offer T&C for the desired offer from here

    • My coupon code is not working. What can i do

Please check if you have followed all the steps to redeem and the T&C for the offer. Please check that the code’s validity has not expired. Please reach out to the respective partner if the Code is still not working.

    • My coupon code expired what can I do

Unfortunately, a code once expired can’t be used or reissued.

    • Can i use these coupon codes on my registered Flipkart Email Address or mobile number only?

No, these codes are not linked to your Flipkart account in any way and can be used using any other account as well.

    • Will I get complimentary coupon codes for every SmartPack that I buy?

Yes, however you can only get one set of complimentary coupon codes per month.

E.g. If you buy 2 Devices with SmartPacks in January, you will get 1 set of coupon codes.

If you buy 1 Device with SmartPack in January and another Device with SmartPack in February then you will get 1 set of coupon codes for each purchase.

    • I do not have an email id. How can I receive the codes?

Unfortunately, there is no other way to receive these complementary codes except via email and it is mandatory to register and verify your email address before order placement or within 2 days from the date of order placement.

  • Data Sharing with External Partners

          • Customers purchasing this Flipkart SmartPack plan hereby understand that their data such as Name, Mobile Number, Email ID, Address, Pin Code etc. may be shared with third party partners for service activation. By agreeing to these terms, customers provide their explicit consent to share this data with third parties.
  • Third Party Service partner

          • Customer agrees that the monthly price charged for the services is fair and agrees to pay the same every month for the chosen period of tenure.
          • Customer understands that market price of services may change in between the tenure, but they will not be eligible to any reductions in price that take place during the tenure. The subscription price of Flipkart SmartPack that they subscribe to, before application of any offer will be considered the final price that will be charged throughout the tenure.
          • Customer understands that all the services being provided in the SmartPack are owned and operated by the respective service provider. Flipkart is not responsible for the fulfillment of the service offering and/or any change in the service offering by the service provider in between the subscription period.
  • Payment

    • Customer needs to mandatorily pay the monthly subscription Program through the Flipkart Platform.
    • Payment can be made through My SmartPacks section available on My Orders page of Flipkart Platform.
    • Customers can use all available payment options except cash on delivery and easy monthly installment (EMI) or No-Cost EMI.
  • Non-payment of Monthly Fees

    • Services can be immediately stopped on non-payment of monthly fees by due date
    • Services can be resumed by paying the due fees along with late payment fees of Rs. 100 within the Grace Period (i.e. within 19 days from the due date).
    • The entire Moneyback promise will be forfeited if all dues are not cleared within 19 Days of Monthly Bill Due Date.
  • Customer Support

    • For any grievance related to activation of Service, Customer can reach out to Jeeves Support.
    • For any grievance related to the service post activation, Customer must to solely reach out to the customer support of the respective service provider directly. Jeeves shall not be liable for any claims, escalations, disputes arising out of the deficiency in services by the specific service provider.
    • Jeeves shall only be responsible for re-directing the customer complaints/escalations pertaining to the subscription services to the respective service partners of Jeeves under this Program. Jeeves shall not be responsible to resolve any complaints/escalations pertaining to performance/usage/after sales service of the subscription plans.
    • You expressly agree not to make Jeeves a party to any disputes/claims pertaining to your usage of the services under subscription plans.
  • Complete Mobile Protection

    • If the customer fails to make monthly payment for selected subscription plan, benefits of the Complete Mobile Protection plan shall also stands terminated along with other benefits of the Program with immediate effect.
    • Complete Mobile Protection shall be governed through its terms and conditions provided at [link]. Please read the detailed terms and conditions of the same.
  • Return / Device Pickup

    • Device Needs to be in Working Condition at the time of pick up after End of Tenure, if customer chooses to return the Device under this Program. Working condition of the Device is defined as where the Device switches on and the IMEI number is visible & legible on the screen. IMEI number must match with the IMEI number on our records that was purchased under this program and for which return is eligible.
    • The customer needs to declare the condition of the Device while placing the request for pickup.
    • Device found with non-genuine parts or repair done by non-authorized service center, then not admissible for pickup.
  • Disclaimer of liability

    • Customer hereby understands and agrees that individual service partners are solely responsible for providing subscription services to customer in accordance with their terms and conditions. Jeeves does not makes any representation and/or warranties regarding the merchantability, fitness or usage of the subscription services. Jeeves shall not be responsible for any deficiency in services by the respective service partners. Notwithstanding anything to the contrary provided hereunder this Terms and Conditions or any other document, communication, email or otherwise, Jeeves expressly disclaims all liabilities for any losses and expenses of whatever nature, including without limitation direct, indirect, general, special, punitive, incidental or consequential damages, loss of income, loss of profit, claims of Customer and/or any third parties or any other losses of any kind. This limitation of liability applies whether the said liability is based on contract, tort (including negligence), strict liability or any other basis. Jeeves also expressly disclaims all express and implied representations, warranties, claims made by the individual service partners of the Program about their respective subscription services. Jeeves also disclaims all representation and warranties regarding merchantability or fitness of the subscription plans and/or Devices and/or any underlying services/claims made by partner service providers of Jeeves.

GENERAL TERMS AND CONDITIONS

  • This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
  • The customer releases and holds harmless Flipkart and Jeeves Consumer Services, its agents, affiliates, and employees from and against any claims, damages, or liability of any kind, including personal injuries, death, or property damage, or any direct, indirect, consequential, incidental or other damages, which the Customer or anyone else may suffer as a result of participation in this Program.
  • The customer agrees that his contact details can be shared by Flipkart with Jeeves Consumer Services. Flipkart Order ID and contact details of the Customer will be shared by Flipkart with Jeeves Consumer Services for verification purposes. The usage of personal data is subject to Jeeves Consumer Services's privacy policy and Flipkart's privacy policy here: http://www.flipkart.com/s/privacypolicy.
  • Customers are not bound in any way to participate in this Program. Any participation is voluntary.
  • Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Program.
  • Flipkart does not endorse the Products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of Product(s). Flipkart shall not be responsible towards any delay or failure of delivery of the Product to any Customer(s) during the provided timeline.
  • The operation of the Program including without limitation the transfer of moneyback, pickup of devices, activation of subscription services shall be subject to force majeure events and on the occurrence of such an event, the Program may be withdrawn at the sole discretion of Jeeves Consumer Services and Jeeves Consumer Services shall not liable for damages to Customers under any circumstances.
  • Flipkart hereby excludes and disclaims all liabilities, whether direct or indirect, that may arise due to the Program. The customer shall contact Jeeves Consumer Services for any disputes/issues related to the Program and Flipkart shall not be held liable for any such disputes/issues. Further, the Customer agrees that for any defects regarding the Product, the Customer shall have a direct recourse against the seller of the Product and Flipkart/Jeeves shall not be held liable.
  • Jeeves Consumer Services shall be solely responsible for fulfilling the terms of this Program. Flipkart shall not be liable for any loss, injury or any other liability arising to the customers as a result of the Jeeves Consumer Services failure to honour its obligations with respect to the customer.
  • Program is subject to federal, state and local laws and regulations and is void where prohibited by law. In the event that the operation, security, or administration of the Program is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Jeeves may, in its sole discretion, either: (a) cancel the Program; (b) suspend the Program to address the impairment and then resume the Program in a manner that best conforms to the spirit of these laws.
  • By entering into this Program, the customer agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fees) that may be suffered by Flipkart as a consequence of (i) violation of the terms of this Policy by the customer; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on the Customer's part.
  • All taxes or liabilities payable to any regulatory authority shall be borne by the customer and/or billed to the account of the customer.
  • The Program and the Terms and Conditions herein shall be governed by the laws of India. Any disputes in relation to the Flipkart Warranty Assistant Plan shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Bengaluru. A sole arbitrator shall preside over the arbitration proceedings with such sole arbitrator appointed by Jeeves Consumer Services.
  • Customers may be able to buy other VAS products available on the Platform along with this Program, however benefits will not get clubbed wherever they are overlapping. Either a customer can claim benefits under other specific VAS products or moneyback benefits under this Program. However, benefits of two plan cannot be availed simultaneously. If customer has availed buyback guarantee or or Smart Upgrade Plan and has returned the device under another plan, moneyback for the device under this Program cannot be availed again.
  • Failure to perform any of the steps mentioned in the T&Cs, will result in cancellation of all benefits vis-a-vis the particular claim
  • By purchasing the Program, it would be deemed that You have given Your consent to contact you through call, SMS or email on the details provided by you for the purpose of this Program.
  • If any provision of these T&Cs shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions hereof shall not in any way be affected or impaired.
  • These T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&Cs.
