Terms & Conditions

This Challenge is being conducted on Flipkart https://www.flipkart.com/superphone-challenge-store operated by Flipkart Internet Pvt Ltd. (" Flipkart") wherein the user (" You", " Your" or " Participant") has an opportunity to participate in the Challenge, subject to the terms of the Policy mentioned below (" Policy").

By participating in this Challenge, You agree to be bound by the terms of this Policy, the Terms of Use, Privacy Policy, Terms and Conditions for Gift Cards (http://www.flipkart.com/buy-gift-voucher) and other relevant documentation that are available on www.flipkart.com, including any modifications, alterations or updates.

Challenge:

Flipkart Internet Private Limited (hereinafter referred to as "Flipkart", "We", "Our", "Us") is conducting the #Superphone Challenge. The Challenge shall begin from 24th July 00:01 hours to 23:59 Hours on 4th August (" Challenge Period"). Upon winning the Challenge, You shall win a Gift Card equivalent to the price of the smartphone verified as superior to the Superphone, sold on www.flipkart.com, subject to the terms and conditions provided below.

Eligibility and Disqualification :

To participate in the Challenge, You are required to do the following during the Challenge Period:

Have a valid email ID atleast 6 months prior to the Challenge
You should have a registered and active Flipkart account ID.
You need to identify any one phone from a particular price band for comparison on Flipkart site only and available at https://www.flipkart.com/superphone-challenge-store. You can choose only one smartphone which will be designated as the Flipkart Superphone for the Challenge.
You have to identify a smartphone from within 5% price band of Flipkart Superphone , from the top 5 brands in the Indian Smartphone Market as per the report published by IDC in Quarter 1 2017 - http://www.idc.com/getdoc.jsp?containerId=prAP42557317.
Such smartphone is required to be available in leading multi-brand large offline retail stores having more than 5 outlets in each city and be present in at least 20 cities across India. Such smartphone shall be designated as the "Challenger Smartphone". You should have purchased the Challenger Smartphone from the select large format retail stores during the Challenge Period only. Smartphones available in exclusive brand outlets or small retail shops will not be eligible for this Challenge.
The Challenger Smartphone needs to be compared with the Flipkart Superphone in the 6 pre-determined features as mentioned below.

You will have to compare the Flipkart Superphone and the Challenger Phone and establish superiority in 4 out of 6 specifications within 5% of he price band of superphone. It is hereby clarified that 4 out of 6 features should be superior and should not be in parity or equivalent in attributes.
You will have to send Your claim, proof of ID (valid govt ID card - Aadhar, Passport, Driving license), comparison entry and proof of purchase (bill in your name, invoice in your name) of the Challenger Smartphone within the Challenge Period to Flipkart at superphonechallenge@flipkart.com through Your registered Email ID on Flipkart.
This email id ( superphonechallenge@flipkart.com) is only meant for participating entries and is not meant for entertaining customer queries or escalations related to the challenge.
The entries should clearly compare the specifications of the Flipkart Super Phone and the Challenger Smartphone either in a paragraph or in a tabular format and describe why the Challenger Smartphone is superior.
Only phones released BEFORE the challenge date i.e 24th July are valid for comparison. Phones released during the challenge period are not valid for entry.
Flipkart will validate the entries sent by You by verifying the claims made by You. Flipkart reserves the right to question the validity of the invoice presented by you.
Senders of valid entries that fulfill all criteria will be considered as winners.
Winners will be contacted by Flipkart directly via email or phone, within 30 days of the Challenge Period. The winner will be gratified with a Gift Card equivalent to the price of the Challenger Smartphone verified as superior.
You are not bound in any way to participate in this Challenge. Any participation is voluntary and the Challenge is being made purely on a best effort basis.
Flipkart, in its sole discretion, reserves the right to disqualify you from the benefits of this Challenge, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Challenge

Redemption of the Prizes:

Flipkart will issue a Gift Card equivalent to the price of the Challenger Smartphone, if the Challenger Smartphone is found to be superior to the Flipkart SuperPhone, to the winner of the challenge.
The Gift Cards will be shared with the winners within 30 days of the expiry of the Challenge Period. To claim the Gift Card, Winners must send their registered email ids to Flipkart via a direct message. The Gift Card codes shall be sent to the email id shared by the Winners by 5th September 2017].
You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Flipkart shall not be responsible in any manner.

Other Terms :

Flipkart reserves the right, at their sole discretion, to change, modify, add or remove portions of this Policy, at any time without any prior written notice to You.
The Challenge prize shall not be settled with cash in lieu by Flipkart.
This is a limited period offer.
This Challenge is valid only in India. The minimum age of such Participant in the Challenge shall be 18 years.
Flipkart reserves the right to determine the winner and such determination shall be as per the terms of this Policy. Flipkart's decision in this regard shall be final.
The Challenge shall be subject to force majeure events and on occurrence of such an event, the Challenge may be withdrawn at the discretion of Flipkart.
Flipkart reserves the right, in its sole discretion, to disqualify any participant / winner that tampers or attempts to violate the terms and conditions.
Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Challenge.
You hereby agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by Flipkart as a consequence of (i) violation of terms of this Policy by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
This Policy shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Policy.
This Challenge is not applicable for the Participants from the State of Tamil Nadu.
The Challenge shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.
