This offer is sponsored by Qarmatek Services Private Limited (“Qarmatek”), and under this offer, users of the Flipkart mobile application and website (“Platform”), who fulfil the terms of this offer can avail buyback of their Samsung galaxy Z Fold 3 and Samsung Galaxy Z Flip 3 at 100% of the purchase price, excluding taxes and availed offers/discounts.

    What is the offer duration?

    • 3rd Nov 2021 (00:00 hrs) to 17th November 2021 (23:59 hrs) (“Offer Period”). First 100 units sold in duration, whichever is earlier.

    What other conditions should apply to avail the offer?

    • User must have purchased the eligible device (Samsung Fold/Flip) during the Offer Period on the Platform.
    • The user will be asked to validate the IMEI number of the eligible device.
    • Customer has to follow the process shared by Qarmatek
    • The device purchased by the user and intended by the user for buyback under this Offer,should meet the QC guidelines of Qarmatek. The device of the user should clear the smartphone conditions tested in the Qarmatek App & should clear all manual checks during doorstep pickup by Qarmatek.
    • Original invoice has to be shared by the user with Qarmatek. A photo of the original invoice also has to be uploaded as requested by Qarmatek.
    • Offer is not applicable on orders under “FSUP” - Flipkart Smart Upgrade program
    • Offer is applicable only in cities of Bengaluru, Hyderabad, Pune, Delhi, Mumbai, Gurugram, Ahmedabad, Kolkata, Chennai and Vadodara .
    • If order is replaced, IMEI replacement will take 48 hours & subject to delay.

    How many times can this offer be availed?

    • One time only. If the device of the user fails the quality checks conducted by Qarmatek, the smartphone is not eligible for offer.

    How will I get paid back if checks are cleared?

    • The user will receive the payment for the buyback via UPI/RTGS within 5-7 working days of the pick-up. In case of rejection, will inform customers of the reason & share the status of this information back to Flipkart.

    Preliminary

    • This offer (“Offer”) is sponsored by Qarmatek Services Private Limited. (“Qarmatek”) on www.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively referred to as “Platform”), which is owned and operated by Flipkart Internet Private Limited (Flipkart, We or Our).

    • By participating in the Offer (defined below), users of the Platform, (“You”, “User”, “Your”’) agrees to be bound by:

      • these terms and conditions (T&C);
      • terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and

    Offer Details

    • The Validity of the Offer (Term) is from 3rd November 2021 (00:00 hrs) to 17th November 2021 (23:59 hrs).
    • The offer is applicable at www.flipkart.com, m.flipkart.com & Flipkart mAPP (mobile Application)
    • Users of the Platform who have purchased Samsung Fold 3 & Samsung Flip 3 (“Device”) during the Term (“Participants”) may be eligible for buyback of the Device by Qarmatek at 100% of the purchase price (“Offer”).
    • To avail this Offer, Participants will have to place a request for buyback with Qarmatek within 15 days from the date of delivery of the Device to the Participant.
    • Participants will receive the buyback value from Qarmatek only if the Device of the Participant passes the quality check requirements as communicated by Qarmatek including but not limited to IMEI checks. The Participants may also be required to provide documentation such as original purchase invoice, etc.
    • Participants will receive payment for the buyback within 5-7 working days from the date of doorstep pickup by Qarmatek or its authorised representatives.
    • Participants will receive communication from Qarmatek with respect to this Offer. The detailed terms of the buyback program of Qarmatek can be found here.
    • This Offer is at the sole discretion of Qarmatek and Flipkart disclaims any and all responsibility, liability or obligations in connection with this Offer, whether direct or indirect.
    • In the event of a return process for which the mode of payment is EMI, the participant will have to manually cancel the EMI with the bank.
    • This Offer is open to only 100 (One Hundred) Participants during the Term.

    Other Terms:

    • To be eligible for this Offer, Participants must :

      • Be an Indian citizen aged 18 years or above.
      • Have purchased an eligible Device during the Term
      • Comply with the detailed terms of the buyback as determined by Qarmatek, available here.
    • Qarmatek/Flipkart shall be free to decline participation if the said requirements are not met.
    • Participants can avail this Offer only once during the Term and only against one Device Purchased during the Term.
    • The Flipkart account ID holder shall be considered for the Offer irrespective of participation. Buyback requests can be placed only by the Flipkart account ID holder and the payment in respect of the buyback will also be made only to the Flipkart account ID holder.
    • This Offer is possible subject to pin code serviceability and is open only to Participants residing in select cities.
    • You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorized persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstandings and Flipkart shall not be responsible in any manner.
    • Flipkart/Qarmatek reserves the right, at any time to verify the validity of participation of Participants in the Offer and to disqualify any Participant from participating in the Offer in the event of any violation of these T&C’s or any fraudulent activity as determined by Flipkart/Qarmatek in their sole discretion.
    • As a condition to accepting the buyback of the Device under this Offer, You may be required to sign any legal documentation as and in the form, required by Flipkart/Qarmatek.
    • Participants of this Offer may be contacted for marketing and promotional purposes by Qarmatek.

    General Terms & Conditions

    1. This Offer is valid only in select cities in India, viz. of Bengaluru, Hyderabad, Pune, Delhi, Mumbai, Gurugram, Ahmedabad, Kolkata, Chennai and Vadodara.
    2. The Offer is open to only end consumers and not resellers.
    3. This Offer is open for participation only to the Users who have purchased the Device from the Platform.
    4. Qarmatek/ Flipkart reserve the right to modify, amend or withdraw this Offer ay any time without prior notice.
    5. Qarmatek/Flipkart reserves the right to terminate, withdraw, suspend, amend, extend, modify, add or remove portions of this Offer, at any time without any prior written notice.
    6. You are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
    7. All decisions pertaining to the buyback and quality checks to be eligible for the buyback are at the sole discretion of Qarmatek based on a metric.
    8. Flipkart/Qarmatek reserves the right to disqualify You from the benefits of this Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the said Offer.
    9. The Offer shall be subject to force majeure events and on occurrence of such an event, the Offer may be withdrawn at the discretion of Flipkart/Qarmatek.
    10. Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Offer.
    11. This Offer is subject to the prevailing laws of India.
    12. By Participating in this Offer, you consent to receiving communications pertaining to this Offer by way of email, in-app notifications, SMS or phone calls by Flipkart/Qarmatek.
    13. Flipkart does not endorse this Offer and will not accept any liability pertaining to the Offer.
    14. Qarmatek is responsible for the fulfilment of the Offer. Any queries/complaints or dispute regarding the fulfillment of the Offer must be directed towards Qarmateks. Flipkart shall not entertain or be responsible for any queries/complaints regarding the fulfillment of Offer.
    15. You hereby agree to indemnify and keep Flipkart/Qarmatek harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fees) that may be suffered by Flipkart as a consequence of (i) violation of the terms of this T&C by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
    16. This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
    17. The Offer shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
    18. Any query regarding this Offer will be entertained only till ____________________________. Post such date Flipkart/ Qarmatek will not entertain any correspondence or communication regarding this Offer from any persons.
