    TERMS AND CONDITIONS

    Preliminary

    • This Offer (defined below) is being extended by Phonepe Private Limited ('PhonePe') on www.flipkart.com, Flipkart Mobile App, Flipkart Lite Platform (all three collectively 'Platform'), which Platform is owned and operated by Flipkart Internet Private Limited ('Flipkart').

    • By participating in this Offer, user ('You', 'Your' or 'Customer') agrees to be bound by:

      • these terms and conditions ('T&C');
      • the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
      • all applicable terms and conditions of Phonepe.

    Offer Details

    • Offer is valid from June 06, 2017 (00:00 hrs) to June 8, 2017 (23:59 hrs) ('Offer Period').

    • To avail this Offer You must do/ fulfill the following:

      • Age must be 18 years or above;
      • Must have a valid account on the Platform and log into the same; and
      • Purchase a Yu Yureka Mobile Phone on the Platform during the Offer Period, using either Your PhonePe wallet or Your credit card/ debit card/ UPI through PhonePe ('Eligible Payment Method'). You are requested to check product page and confirm Offer applicability before making any purchase; and
      • Ensure that the phone number linked to Your account on the Platform is the same as the phone number on which Your PhonePe account has been activated.
    • On the first instance of fulfilling the above requirements during the Offer Period, You will get a cashback of Rs. 300, which cashback will be credited into Your PhonePe wallet within 24 hours of successful completion of the transaction on the Platform ('Offer'). In case Your PhonePe wallet limit for the month has been reached, the cashback will be credited on the first business day of the next month.
    • The maximum cashback that can be obtained as part of this Offer is Rs. 300.
    • In case You make partial payments using any other payment method other than the Eligible Payment Method or avail any exchange offer, the Offer will be valid only if the net transaction value through the Eligible Payment Method is equal to or exceeds Rs. 300.
    • The Cashback amount credited to Your PhonePe wallet can be withdrawn to Your linked bank account using PhonePe app.
    • In case where cashback has been credited to Your PhonePe wallet and You cancel the transaction and You seek a refund, the amount of cashback shall be deducted from the amount of the refund due and payable to You.
    • This Offer can be availed by You only once.

    Other Terms and Conditions

    • This Offer cannot be clubbed with any other payment related Offer.
    • You may not get cashback if Your Flipkart and/or PhonePe account is blacklisted.
    • This Offer is not applicable on Gift Wrap or premium delivery charges.
    • PhonePe and Flipkart are NOT liable or responsible for any claim(s), dispute(s) regarding delivery, service, suitability, merchantability, availability, quantity or quality of any product purchased by You on the Platform, which shall be at the sole liability and responsibility of the seller of such product.
    • PhonePe and Flipkart reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these T&C or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
    • If this Offer and/or anything to be done by Flipkart or PhonePe or any other entity in respect of the Offer is prevented or delayed by causes, circumstances or events beyond the control of Flipkart and/ or PhonePe or any other entity, including but not limited to, tampering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government, or other causes of like or similar or other character beyond the control of PhonePe or Flipkart, then Flipkart and/or PhonePe shall not be liable for the same to the extent so prevented or delayed, and will not be liable for any consequences and on occurrence of such event, the Offer may be withdrawn at the discretion of Flipkart and/or PhonePe.
    • These T&C shall be governed by the laws of India. Any disputes arising out of and in relation to this Offer shall be subject to the exclusive jurisdiction of the Courts in Bangalore only.
    • Under no circumstance will the Offer benefits be settled in cash.
    • Any query regarding the Offer will be entertained till 15th June, 2017, Post such date, Flipkart or PhonePe will not entertain any correspondence or communication regarding this Offer from any Customers/persons.
    • You shall indemnify and hold PhonePe and/ or Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by PhonePe and/ or Flipkart as a consequence of: (i) Your violation of these T&C, of the terms of user agreement, privacy policy (subject to change) as mentioned on the Platform; (ii) Your violation of applicable laws; and (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
    • This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
