| Terms & Conditions | - General Information Flipkart Gift Cards ("GCs" or "Gift Cards") are issued by Pine Labs Limited (formerly known as Pine Labs Private Limited) which is a private limited company incorporated under the laws of India, and is authorized by the Reserve Bank of India ("RBI") to issue such Gift Cards. The gift cards are issued under the brand name of Qwikcilver. There are no fees or other charges associated with Gift Card purchases. You agree and understand that Gift Cards are a pre-paid payment instrument subjected to regulations by the RBI under the RBI guidelines. Flipkart/ Pine Labs Limited (formerly known as Pine Labs Private Limited). may be required to share KYC details of the purchaser/ redeemer of the Gift Card and/or any other information with relation to the purchase of the Gift Cards and/or transaction undertaken using the Gift Card with RBI or such statutory authorities. Flipkart/ Pine Labs Limited (formerly known as Pine Labs Private Limited). may contact the purchaser/redeemer of the Gift Card for any such information. Fraud & Misuse Gift Cards issued to you on account of damaged, defective, or missing products must not be transferred to any other account. Pine Labs Limited (formerly known as Pine Labs Private Limited)/Flipkart reserves the right to cancel such Gift Cards if the same have been found to be transferred to any other account. You are solely responsible for the safety and security of the Gift Cards. Flipkart.com/Pine Labs Limited (formerly known as Pine Labs Private Limited) are not responsible for any acts of omission or commission if Gift Card is lost, stolen or used without permission. Once the Gift Card has been sent to you, you are bound to protect the Gift Card PIN or Gift Card number as confidential. In the event of any misuse of the Gift Card due to loss of any such confidential details due to the fault of the purchaser, Flipkart/ Pine Labs Limited (formerly known as Pine Labs Private Limited) shall not be responsible for the same and no refund will be issued. Pine Labs Limited (formerly known as Pine Labs Private Limited)/Flipkart reserves the right to cancel Gift Cards if the same have been found to be purchased using fraudulent means. In such cases, the funds shall be credited back to the same source from where these were received. In the event that the beneficiary/Know Your Customer ("KYC") details as per RBI Guidelines are found to be incorrect/insufficient, Flipkart.com/Pine Labs Limited (formerly known as Pine Labs Private Limited) retain the right to cancel the Gift Card issued. General Use Policy: Flipkart Gift Cards are intended for personal, non-commercial use only. Any purchase or use of Gift Cards for commercial purposes, resale, or in a manner that constitutes a misuse of our system is strictly prohibited. Purchase Limits and Usage Restrictions: We reserve the right to set and adjust limits on the number, value, or frequency of Gift Card purchases by any single customer, account, or payment instrument. Transactions exceeding these limits, or conducted in a manner designed to circumvent these limits, may be deemed suspicious and subject to further review. Investigation and Action: Flipkart reserves the right to thoroughly investigate any suspected fraudulent, or unauthorized Gift Card activity. If we identify or reasonably suspect that a Gift Card purchase or redemption violates these Terms and Conditions, or is indicative of fraudulent, illicit, or unauthorized activity, we may, at our sole discretion, take immediate action without prior notice, including but not limited to: Immediately cancel, deactivate, or suspend any Gift Cards involved in such activity, or any associated unused Gift Card balance. Forfeit the value of the Gift Cards as a penalty, and no refund or return to source will be issued. Suspend or terminate the associated Flipkart customer accounts, including those linked to the payment instruments used and forfeit all outstanding amounts on that wallet. The usage of specific payment instruments (e.g., credit cards) linked to suspicious or fraudulent activity may be permanently restricted on the Flipkart platform and reported to authorities. Cancel any orders placed using such Gift Cards, whether redeemed or not. Blacklist associated account IDs, payment instruments, or card hash bins to prevent future misuse. Pursue legal action as deemed necessary. Sole Discretion: All decisions regarding suspected misuse, fraud, and the imposition of penalties or actions under these Terms and Conditions shall be made at Flipkart's sole and absolute discretion. Limitation of Liability Flipkart.com/Pine Labs Limited (formerly known as Pine Labs Private Limited) assume no responsibility for the products purchased using the Gift Cards and any liability thereof is expressly disclaimed. Cancellation & Offers Gift Cards once purchased, cannot be cancelled by the Purchaser.
